Conditions of Participation and Data Protection Notice for the "#gcmemecomp" promotion and competition of Koelnmesse GmbH

1. Object

The lottery "#gcmemecomp" is organized by Koelnmesse GmbH (Messeplatz 1, 50679 Köln) - hereinafter referred to as "organizer" or "Koelnmesse".

By entering the competition, participants accept the following conditions of participation. The data protection notice follows after the conditions of participation and is not part of the conditions of participation.

2. Eligible participants

Participation in the action "#gcmemecomp" requires that the participating person has reached the age of 16. By agreeing to the conditions of participation, the participant affirms that he/she has completed the age of 16 and is resident of one of the countries stated below.

Irrespective of this, participation is only possible in the following countries: Germany, Austria, Switzerland, Liechtenstein, Luxembourg, Italy, Spain, Poland, Croatia, Russia, Romania, Czech Republic, Slovakia, Hungary, Bulgaria, Slovenia, France and Belgium. Non-participating persons are not entitled to a prize even if a prize is allocated. Only highly personal registrations are permitted.

3. Participation in the competition and period

The competition starts on 27.08.2020 8:00 am CEST and takes place on Facebook, Twitter and Instagram. There, gamescom fans will be made aware of the lottery. The fans will be given information about participation in the respective entries.

The competition ends on 30.08.2020, 23:59 pm CEST.

A user can take part in the competition by uploading a meme to his Instagram or Twitter account or by uploading it as a visitor post on on Facebook and by always adding the hashtag #gcmemecomp.

The meme must be created by the user who uploads it. It should meet the requirements described in the post or on the gamescom website.

The competition starts on 27.08.2020 8:00 am CEST and takes place on Facebook, Twitter and Instagram. There, gamescom fans will be made aware of the lottery. The fans will be given information about participation in the respective entries.

4. Rights of use, publication of user name and content of the meme, exemption and responsibility

  • The participants agree that their name as well as the contents of their meme in connection with the lottery, the draw, the handling and presentation may be used and distributed by the organizer in online and offline media as well as made publicly accessible to third parties in any other way. For these purposes, the organizer is also permitted to edit the entries and, if necessary, to grant third parties rights of use to them. This granting of rights is free of charge and without any restrictions in terms of space, content or time, unless this is contrary to mandatory law.
  • The participants assure that they are fully responsible for the uploaded content and that no rights of third parties are violated. The participant indemnifies Koelnmesse from any third-party claims resulting from the violation of such rights and from the costs of legal action.
  • Each participant can only win once.

5. Determination of the winner

All submissions will be reviewed and if the criteria for participation are met, will be displayed on the website of gamescom in a gallery. There all visitors can vote for their favourite submissions. The submission with the most votes wins the #gcmemecomp of that day.

6. Profit notification

The winners will be contacted via direct message from the gamescom account on the respective platforms. They have three days to reply to the mail before their prize is forfeited. To receive the prize, a winning user must share his contact information and adress with gamescom account as a reply to the direct message.

Should this be the case, Koelnmesse reserves the right to select a new winner or to have the prize forfeited. A prerequisite for this contact is that the participant have non-private Accounts.

7. Prize

The winners will be announced on all gamescom social media channels.

The prizes include:

  • On Thursday, August 27, 2020: 1 x Xbox Series X console
  • On Friday, August 28, 2020: 1x Gaming Set (Headset, Keyboard, Mouse)
  • On Saturday, August 29, 2020: 1 x PlayStation 5 console
  • On Sunday, August 30, 2020: 1x Nintendo Switch console

Cash replacement, change, exchange or transfer are not possible.

The organizer points out that for organizational or procurement reasons, shipping may take several weeks.

All winners will be awarded a digital certification for succesful participation as well.

8. Exclusion of warranty and liability

a) The organizer points out that the availability and function of the lottery cannot be guaranteed. The competition may be terminated or removed due to external circumstances and constraints without this giving rise to any claims by the participants against the organiser. A warranty or claims for damages of any kind in case of a technical failure or other operational disturbances are excluded. In particular, maintenance, security or capacity concerns, as well as events beyond the responsibility of the organizer (such as disruptions to public communication networks, power failures, etc.), can lead to short-term disruptions or the temporary suspension of services. The organizer does not guarantee that the web pages are available at all times and can be called up by the participants, or that they are free of errors in terms of content or technology.

This may include technical problems, rule changes, decisions or general changes of the respective social media platforms on which users can participate.

The organizer makes every effort to provide correct information, but does not assume any liability or guarantee that the information provided is up-to-date, correct and complete.

The organizer is not liable for incorrect information caused or spread by participants and/or third parties including cooperation partners. In particular, the Organiser does not accept any liability if e-mails or data entries do not comply with the technical requirements set out in these Terms and Conditions of Participation or the technical requirements set out for the website and as a result are not accepted and/or accepted by the system.

The organizer is not liable for offers from third parties, in particular those of Koelnmesse's cooperation partners, which are or were advertised on the community platform. The Organizer does not guarantee that all links and references to external content made within the gamescom Community are correct and/or complete.

b)The following exclusions and limitations of liability shall apply to any liability of the Organiser for damages, notwithstanding the other legal requirements for claims pursuant to this Section 8.

  1. The organizer shall be liable without limitation insofar as the cause of damage is based on intent or gross negligence.
  2. Furthermore, the organiser is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which makes the proper execution of the competition possible in the first place and on the observance of which the contractual partners regularly rely. In this case, however, the organizer shall only be liable for foreseeable damage typical for the contract. The organiser is not liable for the slightly negligent breach of obligations other than those mentioned in the above sentences.
  3. The above limitations of liability do not apply in the event of injury to life, limb or health, for a defect after the acceptance of quality guarantees, for the quality of a product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
  4. Insofar as the liability of the Organiser is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the Organiser.

9. Premature termination of the competition

Koelnmesse reserves the right to cancel or terminate the competition without prior notice due to unforeseen circumstances. This applies in particular if software and/or hardware errors occur and/or other technical and/or legal reasons influence the regular and proper execution of the competition or make it impossible.

10. Applicable law

The competition is subject exclusively to the laws of the Federal Republic of Germany.

11. Exclusion of the participants

Submissions of participants will only be selected if

  • The content is not racist, homophobic, defamatory, obscene, slanderous, glorifying violence, pornographic, insulting, or content which generally does not violate applicable German law.
  • They do not violate the community guidelines of the respective social media platforms (Twitter, Instagram, Facebook).
